Tectil GmbH, headquartered in Bassersdorf (hereinafter referred to as the “Provider”), operates this online portal (hereinafter referred to as the “Portal”). These Terms of Use govern the rights and obligations of the Provider as well as the users of the Portal (hereinafter collectively referred to as the “Users”) concerning the use of the Portal and all services provided by the Provider in connection with the Portal.

1. Offer and Usage

Through the Portal, the Provider publishes information about financial and insurance products, such as service and price comparisons (hereinafter collectively referred to as the “Information”), facilitates advice and mediation related to such financial and insurance products as well as other financial and insurance products requested by Users (hereinafter collectively referred to as “Advice and Mediation”), and sends information via email newsletters to Users (hereinafter referred to as the “Newsletters,” collectively referred to as the “Offer”). The Offer does not constitute an invitation or recommendation to purchase or otherwise acquire any service or goods. The Offer is non-binding for Users.

The Offer is intended exclusively for natural persons with full legal capacity. The Offer is made available to such persons free of charge and for private use. Any use by other natural persons or legal entities, as well as any commercial use, is prohibited. Users waive – insofar as legally permissible – any claims for commissions or other remuneration resulting from Advice and Mediation provided by third parties on behalf of the Provider in connection with the Offer.

Users have no entitlement to use the Portal. The Provider may exclude Users from using the Portal at any time and without providing a reason. Any Portal usage that could endanger its proper operation is prohibited. Users must avoid excessive usage of the Portal – including automated usage.

The Provider is entitled to transfer some or all claims and obligations related to the Offer to third parties, domestically or abroad, at any time.

2. Quality

The Provider strives to maintain high-quality standards for the Offer. Nevertheless, the Provider cannot provide any direct or indirect guarantees or assurances regarding the quality of the Offer, such as the timeliness, accuracy, and completeness of the Information or Newsletters.

Users are required to provide only accurate and complete information and other data to the Provider to ensure high-quality standards for the Offer. Users who submit inaccurate or incomplete data to the Provider are fully liable for any direct and indirect damages incurred by the Provider.

Third parties and their partners, whose advice and mediation are facilitated to Users by the Provider (hereinafter referred to as “Advisors and Mediators”), are particularly obligated to perform their advice and mediation with the utmost professionalism and care at all times, complying fully with applicable Swiss law and relevant professional, provider, and industry-specific guidelines and regulations. Users who cannot receive advice or mediation must be informed by the respective Advisors and Mediators about alternative advisory and mediation options, including direct and – if available – free advisory and acquisition options from the respective providers of the desired financial and insurance products.

3. Warranty and Liability

The Provider operates the Portal professionally and with due care. However, the Portal may be partially or entirely unavailable at times, particularly for technical reasons or due to maintenance. The Provider does not guarantee the functionality or services associated with the Portal. Portal usage is at the individual User’s own risk.

The Provider is liable only for direct damages caused by its own gross negligence or intentional misconduct. Any further liability of the Provider for direct damages, particularly in cases of minor or moderate negligence, is expressly and fully excluded. The Provider’s liability for indirect damages, consequential damages, or damages resulting from incorrect, incomplete, or outdated information is expressly and fully excluded. Liability in connection with third parties and auxiliary persons is also expressly and fully disclaimed. In particular, the Provider is not liable for damages caused by Advisors and Mediators, Information, or Newsletters, nor for damages resulting from errors in electronic communication.

The Provider is not liable if obligations arising from these Terms of Use cannot be fulfilled partially or entirely due to force majeure. Force majeure includes, but is not limited to, acts of terrorism and explosions, uprisings, wars and civil unrest, fires and lightning strikes, floods and other natural disasters, epidemics and pandemics, IT security incidents, nuclear accidents, restrictions or interruptions in power and energy supplies, or telecommunications services, strikes, magnetic storms, unforeseen weather conditions, and government-imposed bans. Force majeure explicitly includes the consequences of SARS-CoV-2.

The limitation of liability according to these Terms of Use applies regardless of the legal basis. Any further statutory mandatory liability remains reserved.

4. Data Protection

General information regarding the processing of personal data as well as the rights of individuals whose data is processed in connection with the Portal can be found in the Provider’s Privacy Policy. If and insofar as the Provider operates the Portal on behalf of another party, the data protection notices on the respective client’s website shall also apply. The Provider collects and processes the data necessary to operate the Offer, either independently or on behalf of others.

The Provider is subject to Swiss data protection law and primarily stores personal and other data on infrastructure located in Switzerland. The Provider collects and processes data that Users provide directly through forms on the Portal, through apps connected to the Portal, or by other means. Such data includes, for example, names, contact addresses, dates of birth, gender, familial relationships, information about newsletter usage, and preferences related to Advice and Mediation. Additional data, such as timestamps, used IP addresses, operating systems and browsers, as well as location data, may be collected by the Provider through Portal usage.

The Provider may process all collected data for any purpose related to the operation of the Portal and the Offer. Data processing may occur for purposes such as information delivery, marketing, market research, risk assessment, and mediation. The Provider is entitled to retain data as long as necessary for the respective purpose(s), but at least for ten years. The Provider implements appropriate technical and organizational measures to ensure data security in proportion to the associated risks.

Users who request information, advice, and mediation through the Portal explicitly agree that the data collected and processed by the Provider for these purposes may be transferred to third parties, such as Advisors and Mediators. This consent also applies to particularly sensitive personal data and data subject to professional confidentiality. Advisors and Mediators are required to comply fully with Swiss data protection law at all times.

Users who request information, advice, and mediation through the Portal explicitly agree to receive information from the Provider via email newsletters and other electronic communication channels. Data collected and processed by the Provider for newsletter distribution may also be used in connection with other Portals operated by the Provider, particularly for newsletter distribution and related offers on those Portals. Users may object to newsletter distribution at any time.

5. Final Provisions

By using the Portal, Users acknowledge these Terms of Use. The Provider may amend these Terms of Use at any time and without providing reasons. The current Terms of Use as published on the Portal apply at all times. If Users do not agree with changes to these Terms of Use, further Portal usage is not permitted.

Should any provision of these Terms of Use be deemed unenforceable, invalid, or ineffective, the enforceability, validity, and effectiveness of the remaining provisions shall not be affected. In such a case, the parties agree to replace the unenforceable, invalid, or ineffective provision with a provision that is enforceable, valid, or effective and closest to the original intent and economic purpose of the parties.

Portal usage and these Terms of Use are governed exclusively by Swiss law, with the Provider’s registered office serving as the sole place of performance and jurisdiction. This does not apply to disputes arising from consumer contracts, where consumers may also sue in their place of residence. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
